This Agreement contains the terms and conditions governing your use of our services offered at the MathRescue.com website. Please read this Agreement before using the website. Use of the website constitutes agreement by the user to all terms and conditions in this Agreement. By submitting any problem(s) to MathRescue.com ("We") for review or using any other resources of information on the website, you agree that you have read this Agreement and understand all of its content and accept all the terms and conditions in the Agreement.
This Agreement may be amended at any time by posting the amended terms on our site under the Announcements section of the Website. Except as stated below, all amended terms shall automatically be effective 30 days after they are initially posted on our site. This Agreement may not be otherwise amended except in writing as signed by you and MathRescue.com.
1. Description of Services
MathRescue.com is a service which offers its users online solutions to
Mathematics problems. While every effort is made to insure the accuracy of the solutions
posted, there is still the possibility of an error occurring within the posted solution.
User agrees not to hold MathRescue.com (or MathRescue.com's agents or employees) liable
for any instruction, advice or services delivered which originated through the
MathRescue.com website.
2. Submission Of Problems For Review
Upon submission of problems by you via e-mail to MathRescue.com,
MathRescue.com will review the problems and determine if the problems can be worked in a
reasonable amount of time and, if so, a fee for such work will be determined. There is no
promise or guarantee that a solution will be offered for any given problem. Further,
MathRescue.com is not in the business of providing complete solution guides to books or
works which have been copyrighted. You agree that you are using our services under the
student "fair use" clause of copyright law for any problems submitted- which
allows a student to copy or reproduce a problem(s) from a copyrighted work for the
purposes of illustrating a problem or assignment. You agree not to reproduce in any form
the solution(s) of any problem(s) provided for you by MathRescue.com other than for your
own personal use. MathRescue.com will not post the original problem(s) submitted to us-
only the solutions. You further agree that you will not advertise, by word-of-mouth or
otherwise, the URL website address at which the solutions to your problems are posted.

4. Payment & Posting Of Solutions
Upon reviewing your submitted problems and determining that the work is
possible for MathRescue.com to accomplish, We will e-mail to you a notice containing the
following: a price, a guaranteed time for posting the solutions to the problems, a URL
address where the problems will be posted, and a deadline for payment to insure the
guaranteed posting time. We will also assign a file number to the problem set. The
notice will be in the form of a PayPal request for payment containing all the relevant
information regarding the problem set. Upon receipt of payment, your solutions will then
be posted by the given time and will be available for you to view over the internet. The
URL address of the posting will be indicated in the original notice as well as a final
notice which will be e-mailed to you at the original e-mail address which you used. The
problems will remain available at the above given URL for a period of 5 days after
posting.
5. User Eligibility.
Our services are available only to individuals who can form legally binding contracts
under applicable law. Without limiting the foregoing, our services are not available to
minors. User agrees to supervise all usage by third parties of the Website under User's
name. User should always supervise User's children's use of the Internet.
6. Privacy Policy .
Our Privacy Policy is available from the homepage
of MathRescue.com. We may modify our Privacy Policy from time to time and any changes will
become effective after we provide you with at least thirty (30) days' notice of the
changes by posting the changes on the announcements section of the Website.

THE WEBSITE AND THE SERVICES PROVIDED BY MathRescue.com ARE PROVIDED
"AS IS" WITH NO WARRANTY. MathRescue.com EXPRESSLY DISCLAIMS ANY WARRANTY,
EXPRESSED OR IMPLIED, REGARDING THE WEBSITE AND ANY SERVICES OFFERED, INCLUDING ANY
IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
MathRescue.com MAKES NO REPRESENTATION OR WARRANTY: (A) THAT THE SERVICE WILL MEET YOUR
NEEDS; (B) THAT ACCESS TO THE SERVICE WILL BE TIMELY, ERROR-FREE, UNINTERRUPTED,
VIRUS-FREE OR SECURE; (C) THAT THE DATA AND FILES YOU SUBMIT TO MathRescue.com WILL NOT BE
LOST OR DAMAGED; (D) AS TO THE RESULTS THAT MAY BE OBTAINED FROM YOUR USE OF THE SERVICE;
OR (E) THAT DEFECTS IN THE SERVICE WILL BE CORRECTED. YOU ACKNOWLEDGE THAT ANY MATERIAL OR
DATA YOU RETRIEVE THROUGH THE USE OF THE SERVICE IS DONE AT YOUR CHOICE AND RISK AND THAT
YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT
RESULTS FROM THE RETRIEVAL OF SUCH MATERIAL OR DATA.
8. Miscellaneous
This Agreement shall not be construed as making either party the partner, joint venture,
agent, legal representative, employer, contractor or employee of the other. This Agreement
shall be interpreted in accordance with the laws of the State of Alabama (excluding any
rules governing choice of laws) and any legal proceeding arising out this Agreement will
occur in Birmingham, AL. This Agreement will be binding on and will inure to the benefit
of the legal representatives, successors and assigns of the parties hereto. This Agreement
constitutes the entire agreement between MathRescue..com and The User.
